Dependents & FamilyImmediate Family (Dependents) The spouse and unmarried children (under 21 years of age) of the primary immigrant or nonimmigrant are considered immediate family members for immigration purposes and are defined as dependents. Many such dependents are eligible for derivative status and may be allowed to apply for work authorization. See Work Permit. As a courtesy, IFSS will include the dependent’s derivative application when filing the University’s petition for nonimmigrant worker. The University is not responsible for any accompanying family member’s visa status or subsequent filing fee(s). While every reasonable effort is made to provide you with guidance with job-related immigration concerns, help cannot be provided for personal or family immigration matters and may be further limited by staff resources and institutional priorities. Other Family Members Although not considered dependents for immigration purposes, the parents, siblings, aunts and uncles of the primary immigrant or nonimmigrant may also be eligible for immigration benefits. These types of family members may also visit the U.S. as a temporary visitor. More > We recommend that the primary immigrant or nonimmigrant (sponsor) provide the family member or person with an Affidavit of Support. This is a promise to support the person entering the U.S. and that the person will not become a public charge. A separate affidavit must be completed for each family member or person. This form is NOT filed directly with the USCIS, but is sent directly to the person to use when applying for a tourist visa at a U.S. Consulate or U.S port-of-entry under the Visa Waiver Program. |
